Abstract [sv]

Syftet med denna studie är att undersöka hur digitala bevis hanteras, dokumenteras och värderas i svenska rättsprocesser, med särskilt fokus på rättssäkerhetsaspekter. Studien belyser utmaningar kopplade till transparens, teknisk dokumentation och domstolars förutsättningar att tolka digital bevisning. 

Analysen bygger huvudsakligen på 41 förundersökningsprotokoll från två olika polisregioner, kompletterade med ett mindre antal domar, rättegångsprotokoll och en intervju med en tidigare domare och åklagare. Resultatet visar att det ofta saknas metadata, att dokumentationen av extraheringar varierar och att digitalt material ibland används utan teknisk verifiering. Det framkommer även att domstolar sällan ifrågasätter bevisens tekniska trovärdighet, trots brister i presentationen. 

Slutsatsen är att avsaknaden av enhetliga rutiner och begränsad teknisk kompetens riskerar att påverka rättssäkerheten negativt. För att stärka tilltron till digitala bevis föreslås bland annat tydligare rutiner, tillgång till sakkunniga och ökad fortbildning inom området. 

Abstract [en]

The purpose of this study is to examine how digital evidence is handled, documented, and evaluated in Swedish legal proceedings, with a particular focus on issues related to legal certainty. The study highlights challenges concerning transparency, technical documentation, and the courts’ ability to interpret digital materials. 

The analysis is primarily based on 41 preliminary investigation reports from two police regions, supplemented by a smaller number of trials, trial transcripts, and an interview with a former judge and prosecutor. The results show that metadata is often missing, the documentation of extractions varies, and digital materials are sometimes used without technical verification. Furthermore, courts rarely question the technical credibility of the evidence, despite deficiencies in how it is presented. 

The conclusion is that the lack of standardized procedures and limited technical competence may negatively impact legal certainty. To strengthen the credibility of digital evidence, the study proposes clearer routines, access to technical experts, and increased training for legal professionals.
